PEGASUS CIVIL RIGHTS COMPLAINT LEADS TO THE END OF DISCRIMINATORY TREATMENT OF STUDENTS IN LOS LUNAS SCHOOL DISTRICT

Los Lunas school officials have agreed to measures that will ensure students will not face discrimination because of their national origin or English language proficiency.

 As a result of a complaint Pegasus filed, Los Lunas School District has entered into an agreement with the United States Department of Education, Office for Civil Rights (OCR) to overhaul its interpretation and translation services for families. The agreement stems from the District having expelled a student without adequate language assistance to the student’s parent throughout the entire discipline process.

Among the many reforms required by the resolution, the District has agreed to:

(1) develop and fully implement a Plan for Oral and Written Language Assistance to provide language assistance services to national origin minority limited-English proficient parents/guardians of students;

(2) develop plans for initial and ongoing training of staff that provide oral interpretation and/or written translation for parents/guardians at the District;

(3) hire an independent, approved interpretation and translation service to provide language assistance until the District implements its Plan; and

(4) provide individual relief to the student, including removing the underlying discipline record from the student’s file.
